Terms and Conditions 

This document sets out the Terms and Conditions upon which the Dietitian is to provide the service to you and will apply to the exclusion of all other terms and conditions (other than those which cannot lawfully be limited/excluded such as any rights which you are entitled to as a consumer). Any variation /addition to these Terms and Conditions will only be valid if they are made in writing and signed by the Dietitian. 

 

In these Terms and Conditions the following words and expressions mean: (a) charges refers those which are payable by you to Sinéad O’Donovan Nutrition for the provision of the service as initially advised to you prior to you placing an order for the service; (b) Dietitian means Sinéad O’Donovan RD, email: info@sineadodonovan.com (c) Services means clinical dietetic consultation services and (d) you mean the individual service user booking the service from the Dietitian. 

 

Sinéad O’Donovan RD reserves the right to change or modify any of the terms contained in these terms and conditions, at any time. Any such modifications or changes will immediately become effective upon posting of such changes. Your continued use of the services will imply your full acceptance of the same. You are therefore responsible for regularly reviewing these Terms and Conditions and additional terms or notices posted on the website. 

 

Consent for care

  1. By engaging in the dietetic services of Sinéad O’Donovan, Dietitian, you are providing consent for the collection of relevant medical, social and demographic data and details to enable Sinéad to complete your assessment and provide a treatment plan.

  2. You are also consenting to other professionals involved in your care being contacted by Sinéad, to gain other relevant information or to give feedback on your dietary treatment or plan where this would be beneficial for your overall care. This will always be discussed with you before other professionals involved in your care will be contacted. 

 

Provision of the service 

  1. You will be provided with a tailor-made dietary treatment plan especially designed to help achieve your goals. All advice given will be evidenced based. As an individual, you are responsible for incorporating this advice into your daily life, taking responsibility for your own decisions and actions. It is not possible to guarantee that any specific result will be obtained as a result of availing of the service. 

  2. You can contact the Dietitian on a medium previously agreed with the Dietitian (eg. text/email) however, the Dietitian is not under any obligation to reply immediately. The Dietitian will strive to reply within 48 hours with the exception of weekends and holidays. 

  3. The service does not include (and the Dietitian shall be under no obligation to provide to you) any services which would be unlawful, illegal or unethical to provide or would require the Dietitian to act in breach of any code of conduct or other regulation to which she is subject. Such services include, but are not limited to: advice on the use of illegal substances or the misuse or abuse of any medications or the treatment of any diagnosed eating disorder (unless such treatment is provided in combination with other healthcare professionals in accordance with all applicable treatment guidelines). The Dietitian does not accept liability for outcomes resulting from the client’s decisions or actions. 

  4. Clients are encouraged to discuss any concerns or questions about the scope of services with the Dietitian before engaging in the dietetic consultation. 

 

Service standards 

  1. The Dietitian ensures that at the date of your order she is a CORU Registered Dietitian (DI057794) and will maintain all professional registrations which may be required to enable her to lawfully provide the service to you. 

  2. The Dietitian shall provide the service to you using reasonable skill and care and in accordance with all legal and regulatory obligations which apply to the Dietitian and the service. 

 

Liability 

  1. The Dietitian does not seek to limit or exclude in any way her liability for: (i) death or personal injury caused by negligence; (ii) for fraud or fraudulent misrepresentation; (iii) for any rights which you are entitled to when dealing as a consumer; (iv) for any remedial action which any regulatory authority having jurisdiction over the Dietitian may order her to carry out; (v) and for any other liability which cannot lawfully be limited or excluded. 

 

Cancellation policy 

  1. At least 24 hour’s notice must be provided if you need to cancel or rearrange an appointment. If you wish to cancel an agreed appointment within 24 hours, then you will be entitled to a refund of 50% of any charges already paid by you. If you fail to attend the appointment, then you will not be entitled to any refund or credit of the charge paid for that appointment. It is understood that in some circumstances, short notice may occasionally be unavoidable and discretion will be exercised where appropriate.   2. In addition to the cancellation rights above, you are free to cancel or terminate the provision of the service at any time and for any reason. However, no refund will be payable to you of any charges paid in advance (or those outstanding) unless the Dietitian agrees at her discretion to do so or where you have terminated the provision of the service because the Dietitian has breached these Terms and Conditions. 

  3. Provided that doing so does not cause her to breach any code of conduct or other regulation which she is subject to, the Dietitian may terminate the provision of the service at any time and should she do so, you will receive a refund of any advance charges already paid by you for services which have no yet been provided. The Dietitian shall not be required to provide any such refund if her reason for terminating the provision of the service is: (a) because you have requested the Dietitian to provide any service to you which would be illegal, unlawful or unethical for her to provide or would result in her breaching any code of conduct or other regulation which she is subject to. 

 

Charges

  1. Payment of all services is required in advance and the Dietitian shall be under no obligation to provide the service to you unless and until service fees have been paid. In the event that the Dietitian agrees to accept payment of the charges in arrears, in instalments or to commence provision of the service prior to you making payment then the Dietitian will be entitled to suspend or terminate the provision of the service without liability to you if you fail to make any payment previously agreed. 

  2. If you are signing up to a programme, you are required to pay in full prior to the programme commencing. You will not be entitled to a refund once the programme begins. 


 

Data Protection Compliance and Privacy Policy 

  1. The Dietitian acknowledges and adheres to the provisions of the Data Protection Acts 1988 and 2003 and the General Data Protection Regulation (GDPR) (EU) 2-16/679. 

  2. By engaging in the dietetic services, you consent to the collection and processing of your personal data for the purpose of completing assessments and providing treatment plans. 

  3. Your personal information will only be used for the intended purposes outlined in our Privacy Policy, and the Dietitian commits to ensuring the confidentiality, integrity, and security of your data. 

  4. Any contact or other personal information supplied by you will be treated in the strictest confidence. Any information provided will not be passed on to any other individual or organisation without your consent.

  5. You have the right to access your data, rectify inaccuracies, and request the erasure of your information if there is no legitimate reason for retention. To exercise these rights, please contact us in writing as info@sineadodonovan.com. We may require additional information to verify your identity. 

  6. You may request, in writing copies of your data held by us as the data controller. We will provide you with a copy of the data held by us as soon as reasonably possible and no more than 30 days after we receive a valid request in writing. Please send all requests in writing to info@sineadodonovannutrition.com. Please be aware that we may require you to provide additional information to enable us to identify your personal data and/or to verify your identity.

 

Copyright 

  1. Any content, graphics, text, trademarks, trade names or logos contained on any material you receive from the Dietitian are protected by copyright, trade mark, and other intellectual property laws under national laws and international treaties and should not be shared with others without the permission of the Dietitian.

Legal Jurisdiction 

  1. These Terms and Conditions are governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these terms, including disputes regarding their interpretation, validity, performance, or termination, shall be subject to the exclusive jurisdiction of the Irish courts. 

  2. By engaging in the dietetic services provided by Sinéad O’Donovan RD, you agree to submit to the exclusive jurisdiction of the Irish courts for the resolution of any disputes. 

  3. In the event of any legal proceedings arising from or related to these Terms and Conditions, the prevailing party shall be entitled to recover reasonable legal fees.
